Alleged gross negligence regarding workmanship

The Respondent employer dismissed a technician for alleged gross negligence regarding workmanship, particularly relating to a job undertaken on brakes of a car. The Claimant then claimed unfair dismissal alleging, inter alia, that he had not been properly trained relating to the issues for which he was dismissed and that the dismissal and appeal process were unfair.

We successfully defended the claim for our client and all claims were fully dismissed by the Tribunal. The evidence at the Tribunal included a physical examination of the brake pads in question, which were provided by the Respondent as part of the evidence and which proved highly persuasive.
