Breach of contract claim successfully defended at Employment Tribunal |
MILS successfully defended a Volkswagon dealer against claims for breach of contract, saving the company in the region of £3,500 in legal fee's. The Claimant had argued that he was entitled to contractual damages owing to an alleged payroll error by a payroll clerk who had accidentally informed the Inland Revenue that the Claimant’s employment had ceased. The error was immediately rectified by our client and MILS successfully argued that no contractual damages could be claimed as the Claimant in question was a worker and not an employee and therefore there was no obligation to give or receive work (known as ‘mutuality of obligation’) from which the claimed contractual losses could flow.
