| MILS assists client in winning misrepresentation claim |

The Claimant claimed for misrepresentation in respect of a motor vehicle he purchased from our client in that the client had failed to disclose to him that the vehicle had been a hire/fleet vehicle. The Claimant said that this a material omission upon which he relied. Our client denied these claims and the Judge at trial found in our client’s favour, namely that there had been no false statement by our client’s salesman. The Judge found that the salesman had truthfully said that there had been one previous owner and had no knowledge until after the purchase that the previous owner was a car hire company and so there was no misrepresentation by omission.
