Major Motor Retailer successfully defends Age Discrimination and Unfair Dismissal claim

A claim of age discrimination and unfair dismissal in the Cardiff Employment Tribunal has been successfully defended by MILS on behalf of a major motor retailer and one of the UK's leading Used Car Supermarkets.

The case revolved around whether or not the claimant, an employee, had sufficient continuity of service to claim unfair dismissal having been dismissed for poor performance with under one year’s service. The employee was arguing that he in fact had over one year’s service and this is a frequent area of litigation and the laws are more complex than some employers initially believe. In the case the Tribunal accepted that the Claimant in question was one day short of qualifying for unfair dismissal and his claims were struck out.  The claim also involved an allegation of age discrimination which was dropped by the Claimant at the Tribunal, after hearing the witness evidence prepared by MILS on behalf of the Respondent.
