Motor Law Solicitors, MILS, have successfully defended a claim of Unfair and Wrongful Dismissal on behalf of one of the UK's largest commercial vehicle distributors. The case involved a manager who was instructing more junior employees to falsify clocking records. His defence was largely based on the fact that a previous manager had condoned the practice and that he had inherited the system from that previous manager. Our retail Motor Industry Law Barristers convinced the Tribunal that the Claimant’s claims should be dismissed, based on his inconsistencies in the internal investigation and at the Tribunal. Our defence was successful and the Judge found in favour of our client, and the dismissal of the manager for gross misconduct was fully justified.
