| Unfair Dismissal Claim Win for Garage |

Motor Lawyers, MILS, have successfully defended a claim from an employee with over 35 year’s service for unfair dismissal, saving a garage over £7,000 in Legal Fee's. The Claimant claimed in the case that he had been dismissed. If the Tribunal had upheld the Claimant’s case then there would potentially have been large damages available given the employee’s length of service. We argued on behalf of the Respondent client that the Claimant had in fact resigned, and persuaded the Tribunal that on the facts the series of events leading up to the Claimant leaving employment (which could be variously interpreted) should be found to be a resignation rather than a dismissal.
