Claims made for unfair dismissal and age discrimination. Case Details:
The Claimant was a car salesman who was dismissed as part of the redundancy selection exercise. The Claimant alleged that his age had been a factor in selection and that the selection was unfair on normal unfair dismissal grounds under the Employment Rights Act 1996. Our Counsel put forward counter arguments to the Tribunal and both the age discrimination claim and unfair dismissal claim were dismissed in their entirety. The schedule of loss was for just over £57,000 and, given the Claimant’s age, any award if the Claimant had succeeded, could have been substantial.
