Updated Vento Bands
MILS clients, who have been involved in litigation with us, will be aware of the case of Vento. This was the case many years ago which set the “bands” for injury to feelings awards in Tribunals.
Vento determined that awards generally fall into three bands: lower, middle, and upper and there is a host of case law on what facts and injuries are appropriate to which band.
From the 6 April 2022 the bands are being adjusted to take into account inflation. For claims presented on or after the 6 April 2022 the bands are as follows:
| Lower band: | £990 – £9,900 | For less serious cases |
| Middle band: | £9,900 – £29,600 | For cases that do not merit an award in the upper band |
| Upper band: | £29,600 – £49,300 | For the most serious cases |
| Exceptional cases: | To exceed £49,300 |
